Don’t I have the right to file my own Bankruptcy. Whats stopping me from doing so?

Question-Mark

Don’t I have the right to file my own Bankruptcy. Whats stopping me from doing so?

You do have the right to file your own bankruptcy petition. However, it is strongly recommended that you don’t do so. The biggest problem that we encounter from time to time is that people attempt to file “pro per”, or filing their bankruptcy petition without an attorney. This is not to say that people aren’t intelligent enough to try to do this on their own. However, bankruptcy law can be very tricky for those who have no experience with it. In some scenarios, people may place their property under the wrong statutory exemption, and end up losing it because the value of the property was not “exempted” correctly. In other cases, especially with a Chapter 13 bankruptcy, the law is simply too complex for a non-attorney to even attempt to file on their own. Some people will file for bankruptcy utilizing the help of a document preparation service. While these people can help with you the filing out of the basic forms for a petition, in truth, these people are not attorneys. To go on the recommendation of any such advice would be very risky, and you could end up losing property rather than saving it. Remember: while it may seem cost effective to file a bankruptcy on your own, everyone eventually needs help with things that they don’t understand. Don’t limit yourself because of cost at the risk of hurting yourself. For more questions and answers visit our webpage: Santa Rosa Bankruptcy FAQs!
